The court reporter tries to transcribe accurately what everyone says. If you or anyone else in the room speaks too quickly, this can be difficult.

Speaking in measured tones makes the court reporter’s job easier, and makes it more likely that the transcript of the deposition will be more accurate. In addition, speaking more slowly than usual can help you to formulate your words more completely and thoughtfully.

The words you say in a deposition and the construction of those words are important because they may be quoted in a later trial. You should use proper grammar, phraseology and facts when you speak in a deposition. The pace at which you speak in a deposition will not be heard in a court of law, unless the deposition happens to be videotaped. sometimes, your sphere of expertise has to refer to acronyms or proper names.

Whenever you use an uncommon word, you can help the court reporter by spelling it. It is also important to use simple “Yes” or “No” responses, rather than just shaking or nodding your head. While the court reporter listens to what you say, he or she cannot easily determine what your head movements mean.

Finally, do not speak while someone else is speaking. Hearing two voices speaking at the same time is challenging for anyone to understand. When you first enter the room, give your business card to the court reporter to help with the spelling of your name, as well as the address to which the copy of the transcript can be sent for your review.

By and large, court reporters edit their reports before submitting them for your review. They accurate for grammar and spelling, but cannot accurate technical misunderstandings regarding your content. That is your job. Remember the court reporter’s typed record is a legal document. It assumes even more legal import when you sign that the transcript is a valid reflection of what you said during the deposition.

It is not over until all the attorneys in the room agree that it is over. They have to tell the court reporter that they are now “off the record.” You cannot relax until that moment. occasionally you may hear an attorney say “that’s all I have;” you might think that the deposition is over at that point. It rarely is. Any of the other attorneys in the room can still ask extra questions. Even the lawyer who said he had no more questions can come back and ask you more, so do not take that proverbial deep breath and relax until the process itself is “off the record” and the deposition officially ends.

Depending on the urgency of the case, the attorneys may press the court reporter for immediate copies of the transcript. They may even ask for an electronic ‘raw’ copy of the deposition. The term “raw” refers to a copy of exactly what the court reporter has typed during the deposition day or days. After the deposition ends, read the transcript that is sent to you and submit any corrections, which will be incorporated as part of the final confirmed transcript. You may not change any details of opinions; only proper any obvious misunderstandings of the words you spoke during the deposition.

If the court reporter thinks he heard something, and you know you did not say the words recorded, you have to catch that. Otherwise, if it is a particularly important phrase regarding your work, you will have allowed a conflict to remain in the record and you will surely have to explain that conflict later at a trial.

Do not put yourself in that possibly embarrassing predicament. Spend the necessary time to reread your own transcript and edit any errors before they are cast in stone.

Some ill-advised attorneys will attempt to simplify matters by waiving your right to read, review, and accurate any errors in the deposition transcript. It’s your neck and reputation that’s on the line here. Do not permit this waiving. Insist on reading through the transcript. It’s not a perfect procedure; there are almost always errors to find.

A deposition reporter is often misconceived as someone who simply records what is said during depositions or court hearings for the sake of legal records. In addition to recording depositions for archival purposes, a deposition reporter also plays a vital role in allowing judges and attorneys to review a deposition speech during the course of a trial and before a trial begins. Because every word of a deposition could be critical to a court case, deposition reporters have an unusual demand for clarity and accuracy placed upon their shoulders at all times. In addition to recording depositions, deposition reporters may also record the speech of legal proceedings, corporate meetings, political meetings and other events that demand a legal record of what was said during the event’s minutes. Whether employed by the court or an independent litigation services provider, deposition reporters typically use one of three recording methods: stenographic, electronic or voice writing.

Stenographic Reporting
Stenographic reporting is the most common method of court reporting. Using a stenotype machine, reporters record the speech of official proceedings by pressing multiple keys at once to record letter combinations that signify phrases, words or sounds. The stenotype symbols are then translated into text by a process known as computer-aided transcription. In court proceedings where real-time reporting is desired, the stenotype machine is connected to computers that translate and transmit speech during a live proceeding. Independent legal services providers often offer real time reporting of legal proceedings by employing real-time reporting proficient reporters.

Electronic Recording
In electronic recording, audio equipment is used to directly record the speech of court proceedings. As the proceeding is recorded, the reporter monitors the recording process, making notes that identify speakers and listening carefully to ensure that the equipment is recording the proceeding with high sound quality. Electronic reporters may use either analogue or digital recording equipment, and are often required to produce a written transcript of the proceeding at its conclusion.

Voice Writing Recording
Voice writing recording is used to record the actual words of court participants as they speak them. In order to keep up with the flow of speech, a voice writing reporter speaks into a voice silencer; a hand-held mask device that contains a small microphone and prevents the recorder’s voice from being heard by the courtroom. In addition to recording what is said by witnesses, attorneys and judges and other parties to a court proceeding, voice writing reporters also make note of histrionic gestures and noticeable emotional reactions. As with electronic reporters, voice writing reporters are generally required to produce a written transcript of a proceeding based on the voice recording. To request a certain kind of deposition reporter or to review a proceeding through a particular reporting style, judges and attorneys often consult with independent legal services providers.

The more modern approach to court reporters, of course, is to record everything electronically. While traditionally video is not permitted in the courtroom, recording devices can be used to record the sound that occurs. So anything that is spoken will be recorded. This is usually a very straightforward process and doesn’t provide the texted real time stream that the other two method can. The recordings are later transcribed by a professional transcriptionist.

Using mics and a recording system works well in courtrooms where it isn’t possible for one person to hear everything being said from a single position, usually due to the size or shape of the room.

The type of court reporter that is appropriate for each case will depend partly on preference, but also on need. The key to maintaining a career is to adapt to new technologies. A career area has embraced the technology is the Court Reporting.

A career as a court reporter offers a wide range of opportunities. The function of a court reporter is to record verbatim court, transcribed statements, recording business meetings, offering real-time translation services for the deaf, and provide subtitling services.

The use of technology in many respects has changed the way court reporters perform their duties. Instead of leaving the field decrease, court reporters have decided to welcome the new technology. Although there have been many technological advances in voice recognition software, humans are required to report the accuracy of the technology. Thanks to technology, court reporters are more connected to all areas of the judicial system. Now you can record data in real time and are involved with video conferencing, Internet communications and e-mail encryption services.

Time reporting involves showing real evidence in real time on computer screens. stenographers have the ability to record and instantly translate testimony and display it on the computer screen during trial. These real-time transcripts can also be printed in a deposition. Final versions of the transcripts have same day availability of such forms as disk, print or share online.

Real-time reporting capability allows further investigation. There is now software that can scan many documents and highlight key words and phrases to improve and strengthen research and preparation of cases. Real-time recording reduces the amount of time it takes to get the right information to the applicant.

Interactive real-time reporting allows focal points to his team to a text witness during testimony. Stenographers use a computer and a stenographic machine. The stenographic allows the reporter to use a shorthand method using speech sounds to record information. The computer uses software called Computer Aided Transcription (CAD) to translate information into English. The information can then be edited, passed to the appropriate official and stored until requested.

Other technological advances in court reporting is the communication time access Translation real or CART. It is used mostly for deaf people, giving them real time access to what is happening. Broadcast captioning is also a prosperous area of court reporters, since they can enter captions of live television programs for the deaf.

Another technological advance court reporters are now using the compression of the transcripts, statements and videos on disks that can be shared with all judicial officers competent.

At present there is a growing demand for court reporters. A study by the Bureau of Labor Statistics found that court reporting job “will increase by 25% in the coming years.” When court reporters to embrace the technological advances and incorporate them into their duties daily work, become more efficient, faster, and therefore more valuable to the legal process. In addition, many fields are using non-legal skills of court reporters.

There was a significant increase in demand in real time reporters subtitles for the hearing impaired. It is a job suitable for court reporters because they are trained and educated to translate word for word the speech into text quickly and accurately. Court reporting is a career that has taken advantage of changes in the technology field is to ensure that is in demand.

With our society at the most litigious time during any point in its history, court reporters are more in demand than ever. Court reporters provide a valuable service to the legal community, creating an official written record of everything that is spoken during trials, motions and depositions.

But where did the court reporting industry start? And more importantly, what are the origins of the equipment and shorthand systems used today around the world?

In order to track down the first official court reporter, one must go back to ancient time – 63 B.C. to be exact. It was in this year that a slave named Marcus Tullius Tiro, the property of the great Cicero became the world’s first shorthand reporter. Tiro first known transcription was of a speech by Cato. To help him copy every word of the speech accurately, Tiro used a series of shorthand notes and symbols. Tiro’s system was simple but groundbreaking. He used single symbols to represents full sentences, and did not record smaller, common words that he knew could be entered into the official record at a later time.

As a result of Tiro’s work, the art and science of stenography was born, and although most of the symbols he used are no longer with us, the ampersand (&) still exists and is a part of hundreds of languages around the world.

The John of Tilbury, a monk, developed the first english shorthand sometime around the year 1180. His system remained the standard in England until the 16th century when a doctor named Timothie Bright created a 500 character shorthand symbol system that would replace it.

Dr. Bright’s system was accepted throughout England until the year 1772 when it was replaced by a new shorthand system developed Thomas Gurney. Gurney worked for the government and his new, easy-to-use system of transcription and note-taking became the official shorthand of Parliament. The final switch in England’s shorthand system came in 1837 when Isaac Pittman developed a phonetics-based shorthand system that is still in use by many British court reporters today.

Across the pond, Gregg’s system was used in the courts of the United States until the invention of the shorthand machine later in the century. In 1879, a man by the name of Miles Bartholomew, who was part of what was already a growing number of professional court reports working in the American legal system, received a patent for what would become the modern typewriter. It had a single keystroke for each letter and would become a major tool of business in the decades that followed.

But for the purposes of modern court reporting, things needed to work more quickly. During the post-war era of the 1950′s the United States Military and IBM developed groundbreaking machines and software that would translate foreign languages directly into English. After this project was complete, the same team of engineers used this technology to create shorthand translation machines.

It was out of this technology that the modern shorthand machine, used today by tens of thousands of court reporters was born.
